A DUI in Utah has civil and criminal penalties. The civil penalties consist of the denial, suspension or revocation of the individual's driving privilege, and the installation of an ignition interlock device in their vehicle. The criminal penalties vary, but at the very least consist of fines and incarceration.
Civil Penalties
In Utah, the Driver License Division suspends or revokes an individual's driving privilege under the following circumstances: Failure to request an administrative hearing within 10 days of arrest; A finding by the Driver License Division that the peace officer had reasonable grounds to believe the individual was driving a motor vehicle while under the influence; the individual pleads guilty in court; or the individual is found guilty in court.
Criminal Penalties
Upon pleading guilty or having been found guilty of a DUI in Utah, an individual is subject to one if not all of the following penalties: jail/prison; electronic monitoring; ignition interlock; fines; compensatory work service; screening and assessment; education; treatment; and additional driver license suspension. The severity of the penalties depends on blood/breath alcohol level; number of previous DUI convictions; age of the accused; and whether there was someone under 18 years of age in the vehicle.
